Prices, discounts and promotions

Prices, discounts and promotions
Pay close attention to prices, discounts and promotions! The legislation applicable to online stores is the same as that applied to physical stores, which means you need to check whether the price reduction you intend to advertise falls within the defined typology (Decree-Law no. 10/2015). And don't forget that you must include the following information:

Sales method (sales, promotions or clearance sales).
Type of products.
Percentage reduction.
Campaign start date and duration period.
Communication to ASAE (only in sales situations).

General information
By law, your online store must include some general information, such as:

Name or company name.
Address and email.
Commercial Registration Number.
Tax Identification Number.
General terms and conditions of sale (shipping, delivery, cancellation, return and exchange policy, etc.).
Online complaints book.
RAL Entity.
Shipping and Payment Information
You will also need to include some information about shipping and payments in your online store, namely the countries/regions to which you ship your products, methods

available payments and additional delivery costs (if any).

Product/service information
With regard to products or services, you must inform customers about their characteristics, total price and method of calculating the price (including taxes, fees, shipping costs and other charges), acceptance of the general terms and conditions of sale and also include a confirmation button that clearly shows that the order implies an obligation to pay: “buy”, “pay”, etc.

Product Returns
When it comes to product returns, by law, customers of online stores can return their items within 14 days, without having to specify a reason and without any type of penalty. Are there exceptions? Yes. Personalized products, among others, cannot be returned.

Billing software
In Portugal, it is mandatory to use certified e-commerce invoicing software to issue invoices with tax validity, and it is also mandatory to report your invoices to the Tax and Customs Authority on a monthly basis, either automatically or by sending a SAFT_PT file on a monthly basis.
Furthermore, if your sales to other countries exceed €100,000/year, you must report them to the Bank of Portugal.
Finally, you must issue your company's invoices immediately after payment, using a digital signature on electronic invoices.

How can you ensure that you comply with all applicable legislation for websites and online stores?
By knowing, applying and complying with current legislation and at the same time, seeking advice from a lawyer… or by delegating this task to a digital marketing company capable of creating professional websites, in accordance with the legislation applicable to websites and online stores, both Portuguese and international. A company like Lusodados!
